This training provides staff with awareness about MCA by promoting and safeguarding the decision-making process that prevails within a legal structure. Additionally, DoLS legally permits a service user to have their liberty deprived of them when they are considered to lack capacity. This refers to the ability to consent to their treatment and care provision that is aimed at keeping them safe from potential harm. 

Participants for this training will gain an understanding of the fundamental MCA principles, issues that affect an individual’s mental capacity, and how mental capacity is tested. Additionally, the aspects of consent and best interests will be addressed. 

Furthermore, participants will gain an insight into the application of DoLS and the requirements for endorsement. 

Participants in completing the training will be able to:

  • List the functions of the Mental Capacity Act.
  • Describe the groups that will be affected by the legislation
  • Explain what is meant by the term ‘best interests’
  • Explain the role of Lasting Power of Attorneys
  • Describe the function of the Court of Protection
  • Explain the Deprivation of Liberty Safeguards.
